Welcome to BD MINTED LIMITED. These Terms of Service ("Terms") govern your use of our website (bdmintedlimited.com) and the purchase of our products and subscriptions. By accessing our site or making a purchase, you agree to be bound by these Terms.

2. Products and Floral Substitutions

All fresh flowers are subject to seasonal availability. We make every effort to ensure that the posies you receive resemble the images on our website. However, because flowers are natural and perishable products, we reserve the right to substitute any flower variety or color with an alternative of equal or greater value and similar aesthetic. By placing an order, you explicitly accept this substitution policy.

3. Subscriptions and Recurring Billing (Important)

When you purchase a Monthly Posy Subscription, you acknowledge and agree to an initial and recurring payment feature.

Automatic Renewal: You will be automatically billed (e.g., £18) on a recurring monthly basis until you cancel.

Cancellation Policy: You may cancel your subscription at any time. However, to avoid being charged for your upcoming scheduled delivery, you must submit your cancellation at least 3 full days (72 hours) before your next billing date. If you cancel after this cut-off, your payment will be processed, your final delivery will be fulfilled, and the cancellation will take effect the following month.

4. Payments and Pricing

All prices are displayed in GBP (£) and are subject to change without prior notice. We use secure, PCI-compliant third-party payment processors (such as Stripe) to handle all transactions. We do not store your credit card details. By submitting payment information, you authorize us and our payment processors to charge the applicable fees to your selected payment method.

5. Delivery and Risk of Loss

We dispatch orders using trusted third-party couriers (e.g., Royal Mail). While we provide estimated delivery dates, these dates are not guaranteed. We are not liable for any indirect losses or damages arising from delayed deliveries caused by courier disruptions or severe weather. The risk of loss and responsibility for the flowers pass to you once the courier records the package as "Delivered."

6. Refunds and Returns

Due to the perishable nature of fresh flowers, all sales are final. Please refer to our separate Refund Policy for detailed instructions on how we handle damaged or faulty items within 24 hours of delivery.

7. Limitation of Liability

To the maximum extent permitted by UK law, BD MINTED LIMITED shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website. Our total liability to you for any claim arising out of or in connection with your order shall not exceed the total amount paid by you for that specific order.

8. Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the English courts.
